Terms of Service

These terms are a binding agreement between you and PVEXT (“we”, “us”) governing your use of the PVEXT platform, including pvext.space, the Studio, the Widget, and any other product or service we currently offer or may introduce in the future (collectively, the “Service”).

1. Acceptance of terms

By creating an account or using any part of the Service, you agree to these terms. If you do not agree, do not use the Service.

2. Accounts

You must provide accurate information and are responsible for keeping your credentials secure and for all activity under your account. Notify us promptly of any unauthorized use.

3. Access keys and credentials

Certain products, such as connected widgets and devices, use access keys or similar credentials to read your Channel’s public data. You are responsible for distributing and revoking your keys. Treat them as secrets; revoke any key you believe is compromised.

4. Acceptable use

You agree not to:

  • use the Service for unlawful, harmful, or abusive purposes;
  • impersonate any person or entity, or misrepresent your affiliation with a person or entity;
  • engage in phishing, scams, or other deceptive or fraudulent conduct;
  • send spam or unsolicited mass messages, or use the Service to distribute malware or other harmful code;
  • publish deceptive content or infringe the intellectual property rights of others, including through copyright or trademark infringement;
  • attempt to breach security, access other tenants’ data, or bypass access controls;
  • overload, disrupt, or scrape the Service or its APIs beyond permitted limits;
  • reverse engineer or resell the Service except as allowed by law;
  • engage in any other activity intended to abuse, disrupt, or compromise the Service or its users.

5. Responsibility for your content

You are solely responsible for all content you create, publish, upload, or distribute through the Service, and for ensuring it complies with these terms, our Channel Guidelines, and applicable law.

6. Channel Owner responsibility

If you create or manage a Channel, you are solely responsible for everything published within it, including campaigns, broadcasts, announcements, actions, messages, uploaded files, images, links, themes, and any other content associated with your Channel. This responsibility applies regardless of whether the content was created by you or by another member with access to your Channel.

7. User-generated content

PVEXT provides the platform and tools for users to create, publish, and distribute content. We do not routinely review, verify, endorse, or actively monitor all user-generated content, and we make no representations about its accuracy, quality, or legality.

8. No monitoring obligation

We are not obligated to proactively monitor every Channel or every piece of user-generated content on the Service. We may, at our discretion, investigate reports, suspected abuse, or suspected violations of these terms, our Channel Guidelines, or applicable law.

9. Content removal and account actions

We reserve the right to remove or restrict access to content, suspend or restrict a Channel, or suspend or terminate an account if we determine, in our discretion, that it violates these terms, our Channel Guidelines, applicable law, or threatens the security, integrity, or operation of the Service.

10. Intellectual property

You retain ownership of the content you create. By uploading or publishing content through the Service, you grant us a limited, non-exclusive license to store, process, synchronize, display, and distribute that content solely to the extent necessary to operate and provide the Service to you. This license ends when you delete the content or your account, except where retained copies are required by law or for legitimate backup purposes.

11. Third-party services

Parts of the Service rely on third-party providers, including hosting, authentication, storage, analytics, and other infrastructure services. The availability, performance, or security of those providers may affect the availability or performance of the Service, and we are not responsible for outages or issues caused by third-party providers outside our control.

12. External links

User-generated content may contain links to third-party websites or services. We do not control, and are not responsible for, the content, availability, security, or privacy practices of those external websites or services. Visiting a linked site is at your own risk.

13. Availability and disclaimer

The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free operation.

14. Limitation of liability

To the maximum extent permitted by law, PVEXT is not liable for indirect, incidental, or consequential damages, or for lost data or profits, arising from your use of the Service, including damages arising from user-generated content or third-party services.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these terms or to protect the Service and its users, as described in Section 9.

16. Changes

We may update the Service and these terms, including to reflect new PVEXT products or services. Material changes to the terms will be reflected by updating the “Last updated” date above. Continued use after changes means you accept them.

17. Governing law

These terms are governed by the laws applicable at the operator’s principal place of business, without regard to conflict-of-laws rules. Any disputes will be handled in the competent courts of that location.
